Terms of Service

Albi is operated by Jorge Gonzalez Cardelus, an individual developer (“Albi”, “we”, “us”). These Terms of Service (“Terms”) are the agreement between you and us covering the Albi mobile app and this website, together the “Service”.

By creating an account or using Albi, you accept these Terms. If you do not accept them, do not use Albi.

You are asked to accept these Terms and the Privacy Policy once, during sign-up. Your acceptance is recorded on your account together with the revision of the documents in force at the time.

The Albi Service

Albi is a place to plan things to do with the people you know, and to keep what came of them. The Service is made up of:

Nooks
A nook is a shared space with a name, an appearance, and a set of members. You create one, invite people, and everyone in it can add to it. Every nook has a group conversation attached to it.
Things to do
Inside a nook you add items — a place, a plan, a memory. An item can carry a name, a description, a location, a start and end time, photos and videos.
Photos and videos
Media attached to items also flows into a personal Gallery of everything from the nooks you belong to.
Comments and conversation
Items have comments. Nooks have a group thread. You can also message another person directly.
Following, and discovery
You can follow people, and be followed. Content you mark as visible beyond your nook appears in other people’s Explore feed and in search, according to the visibility you chose (see §4.5).
Notifications
We send push notifications about activity that concerns you. You can turn them off in your device settings, and mute individual conversations in the app.
Safety tooling
Reporting, blocking, profile privacy, per-conversation privacy settings, and moderation — described in §7.

Albi is an independent project in active development. Features are added, changed, and removed.

How Albi is funded

Albi is provided free of charge. There are no ads, no subscriptions, no in-app purchases, and nothing to buy. We do not sell your information, and we do not use your content to target advertising, because there is no advertising.

You are responsible for your own device, your data plan, and any charges your carrier or internet provider makes for using it.

If this ever changes, it changes through §16 — with notice, before it takes effect.

The Privacy Policy

Running Albi requires collecting and using information about you. The Privacy Policy explains what we collect, why, who it is shared with, how long it is kept, and the rights you have over it. It forms part of this agreement.

Your commitments

4.1 Who can use Albi

  • You must be at least 13 years old. Albi has social features — a public feed, global search, follows, and direct messages — and we do not operate a restricted under-13 mode. Under-13 accounts are not allowed at all.
  • Every account passes an age check before the profile can be completed. We ask the platform first — Apple’s Declared Age Range on iOS, Google’s Play Age Signals on Android — and fall back to asking for your date of birth only where the platform cannot answer. The resulting age band is worked out on our servers from what the platform reported; the app cannot simply assert an age.
  • An account that resolves to under 13 is blocked. The block is permanent for that identity and is not cleared by signing up again. If the check was answered wrongly — a mistyped birth date is a real thing — there is a correction path in the app; corrections are recorded.
  • If you are over 13 but under the age of majority where you live, you may use Albi only with the involvement of a parent or guardian, who accepts these Terms on your behalf.
  • We must not have previously disabled your account for a breach of these Terms or of the law.

4.2 Your account

  • Sign-in is handled by our authentication provider (see §11). You are responsible for keeping your credentials and your device secure, and for everything done under your account.
  • Give accurate information when you sign up and keep it accurate. Do not impersonate anyone and do not create an account for someone else without their permission.
  • Your username is unique exactly as you type it, and it is case-sensitive: @Maria and @maria are two different accounts, and so are usernames that differ only in ., -, or _. Claiming a username reserves that exact spelling and nothing else. Search ignores case, so people can still find you by typing your username in any casing.
  • Because near-identical usernames can coexist, do not pick one in order to be mistaken for someone else. Passing yourself off as another user is impersonation under §4.3, and we will act on it under §7 — including by changing your username, which §5 reserves to us.
  • A username is claimed for good. If the account that holds one is deleted, the username is not released for anyone to re-register — see §8 — because the messages that account sent are still attributed to it.
  • Usernames, first and last names, nook names, and item names are screened automatically for racial slurs and will be rejected. Free-form text — comments, messages, descriptions — is not screened at write time; it is governed by §4.3 and §7 instead.
  • Every text field has a length limit, enforced on our servers. Do not attempt to work around them.
  • Do not sell, rent, or transfer your account, and do not create accounts by automated means.
  • Tell us at chiteki.albi@gmail.com if you believe someone else has access to your account.

4.3 How you can’t use Albi

You must use Albi only for lawful, authorised, and acceptable purposes. You must not:

  • post content that is illegal, or that sexualises, endangers, or exploits children;
  • harass, threaten, bully, stalk, or impersonate anyone, or incite violence or hatred;
  • post someone else’s private or confidential information, or images of a person taken or shared without their agreement;
  • infringe anyone’s copyright, trade marks, or other rights, and you must have the rights to everything you upload;
  • post spam, run scams or phishing, or advertise commercially without our permission;
  • distribute malware, or attempt to gain unauthorised access to the Service, our infrastructure, or anyone else’s account;
  • interfere with the operation, security, or integrity of the Service — including evading rate limits, scraping, or collecting information about users by automated means;
  • reverse-engineer, decompile, modify, or create derivative works of the app, or access the Service through anything other than the interfaces we provide, except where the law says that restriction cannot apply to you;
  • misuse the reporting system, by filing reports you know to be groundless or by using it to harass someone;
  • evade a suspension, a block, the age check, or a storage limit.

Breaking these commitments is what §7 and §8 respond to.

4.4 Permissions you give to us

We do not claim ownership of your content. Everything you put into Albi — nooks, items, comments, messages, photos, and videos — stays yours.

To operate the Service we need a licence. You grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to host, store, reproduce, re-encode, resize, transmit, and display your content, strictly for the purpose of operating, securing, and improving Albi, and consistent with the visibility you chose for it. In practice this is what lets us hold your photos in storage, produce the smaller versions the app renders, deliver your messages, and show your content to the people you shared it with.

This licence ends when you delete the content or your account, subject to §8 — with the exception of copies we are required by law to keep, and of content other people already hold under the permissions in §4.5.

You also agree that we may send you notifications through the app and by push, and that the app may download and install updates.

4.5 Permissions you give other people

This section describes what other users can do with what you post. It is the part of these Terms most specific to how Albi works, and it is worth reading rather than skimming.

Visibility. Every nook, and every item in it, sits on one of four tiers:

An item can never be more visible than the nook it lives in — choose a narrower tier for the nook and its items are pulled down with it. World overrides your profile privacy: content you publish to World is public even if your profile is private.

Nook members. Anyone you add to a nook can see everything in it, add their own items and photos to it, and comment. Adding someone to a nook is how you give them that access.

Losing what you put in someone else’s nook. A nook can be deleted by any of its admins, not only by the person who created it — and deleting a nook takes everything inside it, including the items and photos other people added. The same happens if someone who owns a nook deletes their account: the nooks they own go with them. For 30 days the nook and its contents can be restored; after that they are permanently erased.

This is the mirror image of copying, below: a copy someone made of your item survives you deleting the original, but what you added to someone else’s nook does not survive them deleting the nook. If something in a shared nook matters to you, keep your own copy of it.

Copying (forking). Anyone who can see your nook or your item can copy it into a nook of their own. The copy is theirs. It starts out reading its name and description from your original, and it is clamped to the visibility of the nook they put it in. They can then add their own photos, comments, and details to it.

This is deliberate — it is how a recommendation travels — but it has a consequence you should understand: once someone has copied your item, that copy is their entry in their nook, and deleting your original does not remove it. What they added to it is their content, not yours.

Public profile information. Your username, your display name, and your avatar are shown next to what you post, to everyone who can see it. Your profile Mural — the artwork or photo behind your profile — is shown to anyone who can see the profile itself. If your profile is private, your name is withheld from people who do not follow you, and they see your username instead.

Engagement. People who can see an item can like it, mark that they did it, comment on it, and favourite its photos. Those actions are attributed to them by name and username where they are shown.

Additional rights we retain

  • We may change your username if we believe it is necessary — for example because it infringes someone’s rights, impersonates another person, or was reserved in bad faith.
  • The Albi name, logo, design, and software are ours. Nothing in these Terms grants you a licence to use them.
  • We grant you a limited, revocable, non-exclusive, non-transferable licence to use the app as these Terms permit. No other rights are granted, by implication or otherwise.
  • We may use feedback and suggestions you send us without restriction and without owing you anything for them. You are under no obligation to send any.

Content from other people

Albi shows you content created by other people. We do not pre-screen it, and we do not control what anyone posts. You may encounter things you find wrong or offensive; §7 is how you tell us.

Blocking works differently on Albi than it does elsewhere, and you should know exactly what it does. Blocking someone stops their messages reaching you, and nothing else. It does not unfollow them, it does not hide your content from them, and it does not remove either of you from nooks you share — a person you have blocked can still see what you post where they could see it before. The app calls it “Block messages” for that reason.

A block is also silent by design. The person you blocked is not told and cannot tell: their messages still appear to send, on their side. This protects the person doing the blocking, because a block that announces itself invites retaliation through other accounts. If you need someone removed from a nook, remove them from the nook; if you need them dealt with, report them.

Reporting and enforcement

Reporting. Any item, nook, comment, message, or account can be reported from inside the app, under one of: spam, harassment, nudity, violence, hate, or other, with an optional note. You can only report content you can actually see, and you cannot report your own. One report per person per piece of content counts; if we have already ruled on your report and the behaviour continues, you can report it again and it goes back into the queue.

What happens to reported content. Reports act automatically before anyone reviews them:

  • One or more reports — the content is flagged. It stays visible, but people who are not its owner see a warning and have to choose to view it.
  • Three or more different people reporting it — the content is hidden automatically across the app, and queued for review.
  • A reviewer upholds the report — the content stays hidden.
  • A reviewer rejects the report — the content is restored and marked as reviewed. Further reports will not hide it again; only a reviewer can act on it after that.

Hiding a nook hides the things inside it.

Accounts. Reports about a person, rather than a piece of content, do not act automatically — they go to a queue for a human decision. An account can be suspended. A suspended account cannot do anything on Albi and all of its content is hidden from everyone. We notify you if this happens to you, with the reason. Suspensions can be lifted, and lifting one restores the content that was hidden solely because of it.

Misusing this system — filing reports you know to be baseless, or using reports to harass — is itself a breach of §4.3.

Contesting a decision. If we hide your content or suspend your account, write to chiteki.albi@gmail.com and we will look at it again. We will tell you why we acted unless doing so would be unlawful, would compromise an investigation, or would put someone at risk.

Removing content, suspension, and deleting your account

Deleting content. You can delete your own items at any time, and you can delete a nook if you are one of its admins. It disappears from the app immediately and is recoverable for 30 days, after which it and everything it contained — including the underlying photo and video files — is permanently erased. Deleting a nook deletes everything in it, including other people’s contributions; see §4.5, which is the one consequence of sharing most worth knowing in advance.

Deleting your account. You can delete your account from within the app — see how to delete your account for the steps. When you do:

  • you are signed out immediately, and your content is hidden from everyone straight away;
  • you have 30 days to change your mind — signing back in during that window restores the account and everything in it;
  • after 30 days everything is permanently erased: the items you created wherever they live, the nooks you own and their contents, your photos and videos, your comments, your follows, your likes, your memberships, and the reports you filed. Your identity is then deleted from our authentication provider, which frees your email address for a fresh sign-up.

Three things survive that, and they are stated here so they are not a surprise.

Messages you have already sent stay with the people who received them. A message that reached someone is part of their conversation as much as yours, so deleting your account does not reach into it — in a nook’s group chat and in a one-to-one conversation alike, what you sent remains, and it is still shown as sent by your username, so the conversation stays readable. Your name and your photo are gone from it; your username and the words are not. Your own side of things does go: your inbox, what you had muted, pinned, or read, and any conversation where you were the only person left. If you want a message unsent, delete the message before you delete the account — that removes it for everyone.

Your username is kept, and nobody else can ever take it. This is the other half of the paragraph above: a username that could be re-registered would let someone else step into the conversations you left behind and appear to have written them. So the username is retained and permanently reserved. Note what that means for you — it is not returned to you either. Deleting your account severs the link between you and it, so if you sign up again you get a new account and cannot reclaim your old username. Your email address is freed and can be used to sign up again; your username cannot.

Items other people copied out of your nooks remain in their nooks, as their entries (see §4.5).

Suspension and termination by us. We can suspend or terminate your access if you breach these Terms, if we are required to by law, or if keeping the account open would create risk or legal exposure for us or for other people. Where the breach can be remedied, we will normally tell you first and give you the chance to fix it; we will not where the breach is serious enough to require immediate action — anything involving the safety of a child, in particular.

Survival. If this agreement ends, §4.4 and §4.5 (for content already shared or copied), §5, §12, §13, §14, §15, and §17 continue to apply.

Storage limits

Each account has a storage limit for the photos and videos it uploads, applied across item media, avatars, and profile Murals. The default is 2 GiB. When you reach it, further uploads are refused until you free space; the app shows you where you stand and lets you ask for more, which we may grant at our discretion.

Albi is not a backup service. Keep your own copies of photos that matter to you.

Availability of the service

We will use reasonable skill and care to keep Albi working, but we do not guarantee it will be available, uninterrupted, or free of faults. It may go down for maintenance, because of a failure at one of the providers in §11, or for reasons outside our control.

We may add, change, or remove features, and we may stop offering Albi altogether. If we discontinue the Service we will give reasonable notice in the app and a window in which to save your content, unless we are prevented from doing so or the situation is urgent — preventing abuse, meeting a legal requirement, or addressing a security problem.

Third-party services

Running Albi means relying on other companies. Their terms and privacy policies govern their own services; ours govern Albi. The Privacy Policy sets out the data-protection detail; the list itself is:

PostHog is the only entry on that list you control. Product analytics and session recording are off unless you switch them on: they run on consent asked separately from these Terms, and you can change your mind at any time under Settings → “Help improve Albi”. Recordings are masked on your device before anything is sent, and none of these events carry the text of your messages, your comments, or your photographs. The Privacy Policy sets out exactly what is collected. Everything else in the table is infrastructure Albi cannot run without, so it is not optional — declining it means not using Albi.

You get the app through the App Store or Google Play, and their terms apply to that download alongside these.

App Store. Where you obtained the app from Apple’s App Store: this agreement is between you and us only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, failure to conform to legal requirements, or consumer protection claims, nor for the investigation, defence, or settlement of any third-party intellectual property claim. You confirm that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

Reporting intellectual property infringement

If you believe something on Albi infringes your copyright, trade mark, or other intellectual property right, write to chiteki.albi@gmail.com with enough detail to identify the content, the right you hold, and your contact details. We will review it and remove content where the claim is made out.

We may suspend or terminate the account of anyone who repeatedly infringes other people’s intellectual property rights.

Disclaimers

Albi is provided “as is” and “as available”. To the fullest extent permitted by law we make no warranties of any kind, express or implied, including as to merchantability, fitness for a particular purpose, title, or non-infringement, and we do not warrant that the Service will be uninterrupted, secure, error-free, or that content will never be lost.

We are not responsible for, and do not control, what other users post or do. Nothing in this section limits our obligation to act with reasonable skill and care, or affects rights you have as a consumer that cannot be excluded.

Limitation of liability

We are liable without limit for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for anything else the law does not permit us to limit.

Otherwise, and provided we have acted with reasonable skill and care, we are not responsible for: losses not caused by our breach of these Terms; losses that were not reasonably foreseeable to both of us when you accepted these Terms; content posted by other users; and events beyond our reasonable control.

To the fullest extent permitted by law we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Because Albi is provided free of charge, our total aggregate liability to you is limited to one hundred euros (€100).

If you use Albi other than as a consumer, you agree to indemnify us against claims, losses, and reasonable legal costs arising from content you posted or from your breach of these Terms.

Governing law and disputes

Albi is operated from Spain. These Terms are governed by the laws of Spain, and the courts of Spain have non-exclusive jurisdiction over any dispute — subject to the paragraph below, which is what applies to most people reading this.

If you are a consumer resident in the EU or the UK, that choice does not deprive you of the protection of the mandatory rules of the country where you habitually live, and you may bring proceedings in your own country’s courts. In practice the clause above governs non-consumer disputes and acts as the fallback; it does not move a consumer’s case to Spain.

Consumers may also be able to take a complaint to a consumer dispute resolution body in their own country. In Spain that is the consumer arbitration system (Sistema Arbitral de Consumo) and the regional consumer offices. The European Commission’s online dispute resolution platform, which older terms often point to, closed on 20 July 2025 and is deliberately not referred to here.

Before starting a formal dispute, please email chiteki.albi@gmail.com — almost everything is faster to fix directly.

Updating these Terms

We may update these Terms as Albi changes — to reflect new or changed features, to correct mistakes, or to keep up with the law. How much warning you get depends on what the change does to you.

Changes that disadvantage you. Where a change materially reduces what you can do on Albi — removing a feature you relied on, adding a restriction, or lowering a limit — we will give you at least 30 days’ notice before it takes effect, so you can read it first and decide. You may end this agreement at any point in that window by deleting your account, at no cost and without giving a reason.

Changes that don’t. Everything else takes effect when it is published: corrections and clarifications that do not change what the Terms mean, new or improved features, and changes that are purely in your favour.

Changes we cannot wait on. We may make a change effective immediately, giving notice as soon as we reasonably can afterwards, where it is needed to comply with the law or with an order from a court or regulator; to close a security vulnerability; or to respond to fraud, abuse, or an urgent risk to people using Albi. The notice will still say what changed and why.

We give notice in the app, and by push notification where you have them enabled. The effective date at the top always reflects the version in force.

If you continue using Albi after a change takes effect, you are bound by the updated Terms. If you do not accept them, stop using Albi and delete your account.

Other

  • These Terms, together with the Privacy Policy, are the entire agreement between you and us about Albi, and replace anything said before.
  • If a provision is found unenforceable, it is narrowed to the minimum extent needed to make it enforceable, or severed; the rest stays in force.
  • If we do not enforce a provision, that is not a waiver of it. Any amendment or waiver you propose needs our express agreement.
  • You may not transfer your rights or obligations under these Terms. We may transfer ours — for example on a sale of the project — and will only transfer your information in compliance with data-protection law.
  • These Terms do not give rights to third parties, except as stated for Apple in §11.
  • Albi is not intended for use where doing so would breach local law, and we may limit availability in any country. You must comply with applicable export control and sanctions laws.
  • Nothing in these Terms prevents us from complying with the law.
  • Nothing in these Terms limits consumer or data-subject rights that cannot be waived by contract.
